Category: Case Support Services | Product page: https://fundcapitalamerica.com/services/policy-limits/ (full terms: https://fundcapitalamerica.com/terms/policy-limits-agreement/) | Also applies: Master Terms and Privacy Policy.

The Policy Limits Terms and Agreement (effective October 26, 2026) apply as published and are available in full on the Policy Limits Terms and Agreement page. Four short additions in B-3 apply together with them. Apart from B-3, nothing in the Master Terms or this page changes a Policy Limits business term. If the Master Terms and the Policy Limits Terms differ on a Policy Limits request, the Policy Limits Terms control, and the additions in B-3 control over the Policy Limits Terms on the four points they cover.

B-2. Quick reference (summary only; the full Policy Limits Terms control)

B-3. Additional Policy Limits terms (apply together with B-1)

These four additions apply to every Policy Limits request together with the Policy Limits Terms and Agreement. If one conflicts with the Policy Limits Terms, the addition controls. They also appear at the end of that page.

B-3.1 Sharing and resale of Results. A firm may share a Result only as needed for the matter it was ordered for: with its client, co-counsel, experts and the court, and, where needed for a demand, litigation or settlement, with an opposing party or its insurer. A firm will not otherwise share a Result with an opposing party, its counsel or insurer, and will not resell, license or redistribute a Result or use it to build a competing database or service. This replaces the sharing wording in Sections 8.2 and 9.2 of the Policy Limits Terms where they differ.

B-3.2 Authorized Signator. Where the Policy Limits Terms refer to an "authorized FCA officer," it means an Authorized Signator of FCA as defined in Master Terms Section 4.1A.

B-3.3 Promotional items. Modest promotional items and refreshments FCA offers at office visits or events are not given in connection with, or conditioned on, any Request, referral or funding, and do not change any price or term. This applies together with Section 3.8 of the Policy Limits Terms and Master Terms Section 5.4.

B-3.4 Use of Request information. FCA uses information from a Policy Limits Request for that Request. If a law firm asks FCA to consider the matter for funding or another FCA service, FCA may use the information for that purpose, under the Master Terms and the schedule for that service. FCA does not use Request information to market to Claim Subjects. This clarifies Section 7.4 of the Policy Limits Terms.
