Category: Financial Services | Product page: https://fundcapitalamerica.com/legal-funding-for-attorney/ | Also applies: Master Terms and Privacy Policy.

G.1 What this covers. Funding and support for law firms, including case cost funding (money advanced to pay the costs of a case, such as filing fees, experts and records) working capital, portfolio or case-inventory funding (funding secured by a group of the firm's cases) and post-settlement funding (funding against settlements reached but not yet paid). The categories, scope, eligibility and pricing are on the product page, as posted when the request is submitted. A signed funding agreement controls.

G.2 Who the funder is. FCA may provide this funding directly, only where the law allows (currently California), or may refer the request to, or broker it with, independent funders. The funder is FCA or an independent funder, and is named in the written agreement the law firm signs. Where an independent funder provides the funding, FCA is not a party and Master Terms Sections 3 and 4 apply. Funding is not final until a written agreement is signed by the law firm and the funder (and by FCA, if FCA is the funder).

G.3 Law firm responsibilities. The law firm is responsible for its own professional and ethical obligations. It confirms that: the information it gives is accurate and complete; it has authority to enter the agreement; it will use funds as the agreement states; the funding does not require, and it will not give, the funder or FCA any control over its cases, strategy, settlement decisions, fees or client relationships; and it will not share a client's confidential information without the client's informed consent and as the law and professional rules allow.

G.4 No fee sharing and no ownership. FCA and funders take no ownership of, and share no legal fees with, a law firm, and a law firm funding is not conditioned on, and does not pay for, referral of any client for funding or any other service. Funding for a law firm is separate from funding for a Plaintiff, and neither is a condition of the other (Master Terms Section 5.4).

G.5 Repayment and security. Repayment, charges, whether the funding is recourse or non-recourse, any security or collateral, and early payoff are as stated in the signed agreement.

G.6 Commercial financing disclosures. Where a state requires commercial financing disclosures (for example the amount funded, total cost and payment terms), FCA or the funder gives them before signing.

G.7 Decisions and timing. Approval, amount and timing are not guaranteed. Funders decide for themselves, and FCA does not control or guarantee their decisions (Master Terms Section 3).
