Category: Medical Legal Funding is a Financial Service; FCA MedConnect is a Case Support Service | Product pages: https://fundcapitalamerica.com/services/medical-legal-finance/ (medical legal funding) and https://fcamedconnect.fundcapitalamerica.com/ (MedConnect) | Also applies: Master Terms and Privacy Policy.

F.1 What FCA MedConnect is. FCA MedConnect is a concierge and marketing service. It helps the clients of a law firm find medical providers that accept liens and book an appointment, and it markets Medical Providers on its network. FCA does not provide medical care, does not employ or supervise any provider, and does not evaluate or direct treatment. Medical legal funding of treatment or receivables, if offered, is provided by independent funders or providers under their own agreements.

F.2 How FCA is paid. FCA may receive monthly or other fixed marketing fees from Medical Providers and related entities, as Master Terms Section 6.4 states. FCA does not receive a fee for each patient, case or referral. A Law Firm, patient or funder pays FCA nothing for a medical referral. FCA tells the patient and the attorney, before an appointment, that Medical Providers pay FCA for marketing and listing.

F.3 What FCA checks about providers. FCA checks only that a provider on the network is willing to treat on a lien. That is the whole of what FCA checks. FCA does not verify a provider's license, insurance, credentials or history, and does not evaluate or promise the quality, safety, cost, billing, availability, timing or results of any provider's care or records. FCA does not say a provider will give good care or a particular result.

F.4 No responsibility for providers. Medical Providers are independent. Their decisions, treatment, billing, liens, lien amounts, records and conduct are their own. FCA is not responsible for them, for any complaint about them, or for any harm, cost or delay arising from their services, and is not a party to a treatment, lien or funding agreement between a patient, a provider, a law firm and any funder, unless FCA signs it as a party. FCA's responsibility for its own statements and conduct, including its own concierge scheduling, is not limited by this section.

F.5 Patient choice and information. The patient and the attorney choose the provider, may choose a provider that is not on the FCA network, and may decline an appointment without penalty. FCA suggests providers by location, specialty and availability, and not by how much a provider pays. Information the patient gives to book an appointment is shared with the provider the patient chooses (Privacy Policy, Section 4).

F.6 No steering by case value. FCA does not choose or promote a provider based on the value of a case or the amount a provider has paid.

F.7 Medical legal funding and finance. Medical legal funding and finance (funding for ongoing treatment during a case, and financing for medical providers) is described, with its scope and pricing, on the page at https://fundcapitalamerica.com/services/medical-legal-finance/, as posted when the request is submitted. Whoever provides the funding or financing, whether FCA or an independent funder, is named in the written agreement, and no funding exists until that agreement is signed (Master Terms Section 4). Funders and providers make their own decisions and set their own timing (Master Terms Section 3).
