GranuFlow Lawsuit Loans & Pre-Settlement Funding

At FCA Legal Funding, we are familiar with GranuFlo cases and the dangerous effects that GranuFlo and NaturaLyte have had on dialysis patients with chronic and acute kidney failure. What we offer is not a lawsuit loan. Nor does it come with the obligations of a traditional loan. We provide non-recourse legal funding that is paid only out of your future settlement. There is no credit review or collateral involved; only the merits of your case are considered in qualifying you for funding.

You can receive a cash advance if you have an active GranuFlo lawsuit. The drug was approved by the FDA in 2003; the agency publicly acknowledged its dangers in 2012. A Class 1 Recall was issued, meaning that regulatory agencies believe use of or exposure to a product can lead to serious health problems or death. Despite the serious health risks, the product has still not been removed from the market.

What is GranuFlo and NaturaLyte?

Both of these dialysates (dialysis additives) are chemical substances used to clean patient blood and remove waste while it is in dialysis machines. By treating blood this way, acid buildup in the kidneys can be prevented, stimulating kidney function. Alkali dosing errors and higher concentrations of active ingredient compared to similar dialysates have negated these benefits, sometimes leading to unintended overdoses.

An overdose of GranuFlow (sodium diacetate) causes high serum bicarbonate levels, which can be life threatening (the acetate is naturally converted by the liver into bicarbonate). While the drug is a dry powder acid concentrate, and NaturaLyte is a liquid acid concentrate, both are associated with the same potentially serious side effects. An estimated 125,000 patients receive these dialysates in the U.S., where about one-third of dialysis patients visit clinics run by drug maker Fresenius Medical Care on a regular basis.

Symptoms and Injuries Associated with GranuFlo

In lawsuits, the most frequently cited plaintiff complaints include:

  • Low blood pressure
  • Low blood oxygen levels (hypoxemia)
  • Low potassium (hypokalemia)
  • Increased blood carbon dioxide (hypercapnia)
  • Irregular heartbeats (arrhythmia)
  • Elevated tissue pH (metabolic alkalosis)

Some of the milder side effects include fatigue, numbness, and tingling, but muscle damage and paralysis can occur as well, including to the heart, due to a drop in potassium.

An overdose can cause heart attack, cardiac arrest, and a host of cardiovascular problems including congestive heart failure as well as stroke and sudden death.

FDA Warnings, Recalls, and Reports

The FDA issued a Class I Recall of GranuFlo and NaturaLyte products in March of 2012. The most serious of recalls, it led drug producer Fresenius Medical Care to voluntarily change labels on these products. A Class 1 Recall was issued, but despite the serious health risks, the product has still not been removed from the market.

The drug was approved by the FDA in 2003, which publicly acknowledged its dangers in 2012. An internal Fresenius memo was received anonymously by the FDA on November 4, 2011. At the time, it linked 941 cases of cardiac arrest to overdoses and detailed other risks as well. The agency then issued a safety communication directly to doctors. The memo was not published publicly until May 2012, after the document was leaked to the FDA.

History and Current Status of GranuFlo Litigation

Lawsuits against Fresenius started about two months after the recalls. Harmed patients and family members who had filed lawsuits on deceased loved ones’ behalf claimed the company had sold and marketed a deficient product, and neglected to warn patients and doctors of potentially fatal side effects, including cardiac arrest. Some early lawsuits sought damages for medical bills, pain and suffering, lifestyle changes, and wrongful death.

Others alleged Fresenius intentionally withheld information on the risks of GranuFlo and NaturaLyte, and willfully kept out of network medical facilities in the dark about the knowledge it had. Meanwhile, the company had allegedly warned doctors and medical directors at its own clinics. The organization has also been accused of negligent and fraudulent marketing, and of disregarding public safety by failing to issue a timely recall.

In 2014, the state of Louisiana filed a lawsuit against the manufacturer for knowing about how the drug could increase bicarbonate levels. It also claimed the company defrauded the state’s Medicaid program.

In Massachusetts, over 1,800 lawsuits were filed as part of a multidistrict litigation. There were 515 ongoing lawsuits by February 2014. All suits involved individuals who were adversely affected or experienced the death of a loved one due to the use of GranuFlo and/or NaturaLyte.

Fresenius Medical Care paid $250 million in an agreement to settle various claims on its drugs in February of 2016. In June of 2018, a Denver jury awarded families of three dialysis patients $383.5 million in a wrongful death lawsuit, including compensatory and punitive damages.

GranuFlo Legal Funding FAQs

We strive to improve the chances you won’t settle for less than your case is worth, but can’t predict an exact settlement amount. Multiple GranuFlow lawsuits have settled in the hundreds of millions of dollars. The value of your case depends on the effects of the drug, how they impacted your health, and the ongoing limitations they have caused.

Pre-settlement funding provides the cash you need right away, not when your lawsuit settles months or years from now. Legal funding is available quickly (we can get cash to you 24-48 hours after you apply and we speak with your lawyer). The cash can be used to pay for any financial obligation you have—we do not track or limit how you spend it.

To qualify, you must have been harmed by GranuFlo or NaturaLyte, or have lost a loved one fatally harmed by them, and be working with an attorney. There are no upfront payments and you never pay anything out of pocket. The process is fast and paperless. Term-based payback means you don’t repay if your case doesn’t win, and repayment comes directly out of your settlement.
