The FDA issued a Class I Recall of GranuFlo and NaturaLyte products in March of 2012. The most serious of recalls, it led drug producer Fresenius Medical Care to voluntarily change labels on these products. A Class 1 Recall was issued, but despite the serious health risks, the product has still not been removed from the market.
The drug was approved by the FDA in 2003, which publicly acknowledged its dangers in 2012. An internal Fresenius memo was received anonymously by the FDA on November 4, 2011. At the time, it linked 941 cases of cardiac arrest to overdoses and detailed other risks as well. The agency then issued a safety communication directly to doctors. The memo was not published publicly until May 2012, after the document was leaked to the FDA.
Lawsuits against Fresenius started about two months after the recalls. Harmed patients and family members who had filed lawsuits on deceased loved ones’ behalf claimed the company had sold and marketed a deficient product, and neglected to warn patients and doctors of potentially fatal side effects, including cardiac arrest. Some early lawsuits sought damages for medical bills, pain and suffering, lifestyle changes, and wrongful death.
Others alleged Fresenius intentionally withheld information on the risks of GranuFlo and NaturaLyte, and willfully kept out of network medical facilities in the dark about the knowledge it had. Meanwhile, the company had allegedly warned doctors and medical directors at its own clinics. The organization has also been accused of negligent and fraudulent marketing, and of disregarding public safety by failing to issue a timely recall.
In 2014, the state of Louisiana filed a lawsuit against the manufacturer for knowing about how the drug could increase bicarbonate levels. It also claimed the company defrauded the state’s Medicaid program.
In Massachusetts, over 1,800 lawsuits were filed as part of a multidistrict litigation. There were 515 ongoing lawsuits by February 2014. All suits involved individuals who were adversely affected or experienced the death of a loved one due to the use of GranuFlo and/or NaturaLyte.
Fresenius Medical Care paid $250 million in an agreement to settle various claims on its drugs in February of 2016. In June of 2018, a Denver jury awarded families of three dialysis patients $383.5 million in a wrongful death lawsuit, including compensatory and punitive damages.
